Thaawarchand Gehlot says ‘bias in determining OBC creamy layer’

The Union social justice minister, Thaawarchand Gehlot, has told the government that uniform criteria were not being applied for determining “creamy layer” among backward castes whose parents work in state-run companies.

Gehlot recently told the department of personnel & training that the accepted “equivalence certificates” issued by public sector units for certain successful candidates while turning them down for others where they chose to apply the “income criteria”.

In a meeting comprising senior representatives of ministries of law and social justice, and the DoPT on December 13, 2018, Gehlot pointed out that the declaration about applying “income criteria” may not be true. Citing the complaint, he said there were instances where “equivalence certificates” had been accepted for candidates in the same examination.

Gehlot said, “DoPT may comply with their OM of 1993 (income criteria) for determination of creamy layer. However, they may also keep in view the instances quoted in the representation, of rank holders 621 and 723 of Civil Services Exam, 2015, wherein they may have accepted equivalence certificates issued by the State Bodies (PSUs).”
