After Article 370 defanging, all Indian laws will now be applicable to J&K and Ladakh

New Delhi: Jammu & Kashmir, been a special status granted to the state, was exempted from implementing certain laws so far that are otherwise executed all over the country. With the decision of withdrawal of special status and designate J&K as a Union territory, taken by the central government, on Monday, all the laws that are applicable elsewhere in the country, will now be applicable in J&K also.

General laws such as property related laws, criminal laws, Right to Information and Education law will be applied in the state. Now onwards, all the laws passed by Parliament will be extended to the state. The state flag with a plough and three stripes will lose its recognition.

The criminal laws including the Indian Penal Code, the Criminal Procedure Code, the Indian Evidence Act, National Security Act, Prevention of Corruption Act, Scheduled Caste and the Scheduled Tribes (Prevention of Atrocities) Act, The Protection of Children From Sexual Offences Act and The Juvenile Justice (Care & Protection of Children) Act

will now be implemented in the state. Personal laws such as The Hindu Succession Act, 1956; and The Muslim Personal Law (Shariat) Application Act, 1937 are proposed to be applicable to the region.

The withdrawal of Article 35A will now allow any citizen of India to acquire immovable property in the state. Non-residents of valley will be able to get land on lease if the proposed amendments will be made in the Jammu & Kashmir Land Grants Act.

J&K and Ladakh regions, are being proposed to recognize as Union territories, will now be directly govern by the central government. According to the Section 73 of the bill, the President has all the rights to suspend any or all provisions of the law if any such situation arises.
