Supreme Court rejects Lalu Prasad’s medical bail plea in fodder scam

New Delhi The Supreme Court, on Wednesday, rejected the bail plea of Rashtriya Janata Dal chief Lalu Prasad in the multi-crore-rupee fodder-scam cases, in which the Bihar leader has been convicted by lower courts. A bench headed by Chief Justice of India Ranjan Gogoi said it is not inclined to let Prasad out on bail in the cases.

In the bail plea, Prasad’s argued that he has been in jail for 24 months. On this, the court said Prasad has so far served only 24 months against his “25-year conviction”.

Kapil Sibal, who was representing Prasad, said the RJD leader was given a “14-year sentence and not 25 years”, and he wasn’t “running away”. On this, Justice Gogoi said, “Whether it is 25 years or 14, the high court will decide … We can ask the high court to expedite the cases against politicians.”

The bench also said the merits of the case will be decided by the high court and currently it was only hearing the RJD leader’s bail plea.

On Tuesday, the Central Bureau of Investigation had strongly rejected Prasad’s bail plea on medical grounds. The CBI claimed that granting him relief would not only be against the court’s zero-tolerance policy in corruption, but would also be setting a very wrong precedence in all corruption cases.

In a counteraffidavit filed in the apex court, the investigation agency said that the RJD chief wants to continue his political activities for the Lok Sabha election in the name of the medical bail.

The agency claimed: “Prasad is moving for bail simultaneously on medical grounds and to guide the party to carry out all essential responsibilities as a party president.”
