Justice Dipak Mishra says ‘marital rape should not be an offence’

Justice Dipak Misra, former chief justice of India, has expressed his views about marital rape. He said that in his opinion marital rape should not be considered as an offence. He added that there is no need of implementing any kind of law in regards of marital rape.

Participating in the inaugural session of “National Conference on Transformative Constitutionalism in India: Reflections on Shifting Paradigms”, on Monday, Misra has made his statement during an interactive sessions with law students. Interestingly, he made the statements when a first year LLB student asked him: “Don’t you think rape laws in India must be amended? Shouldn’t rape laws be made gender neutral and marital rape also be considered a crime?”

Misra said borrowed ideas are not acceptable in all circumstances. “Because some countries of the world have made marital rape an offence … I don’t think India should do the same. It will create anarchy in many families. Our countries is sustaining because of the family platform.”

It may be noted that there is no any law for marital rape or man forcing his wife to have sex. Women’s rights activists have been fighting at various forum to make it illegal and punishable offence.
